By signing this waiver, I certify that I have read, fully understand, and am responsible for complying with the Pool Rules & Regulations and schedule.
Swimming under this waiver releases and holds harmless all members of the community association named below (“Association”), the association’s Board of Directors, the association’s contracted pool management company, its employees, and Professional Properties Management of Raleigh, Inc. (“PPM”), including their employees, from any responsibility of any and all claims, injuries, damages, or losses arising from the use of the pool during unguarded hours, whether caused by negligence or otherwise incurred while swimming during unguarded pool hours.
This waiver is null and void when the pool is closed. When the pool closes, I must leave the premises immediately or I will be considered trespassing.
I am a member in good standing with the Association for use of the pool and I am age 18 or older. My assessments are paid in full and I understand that if my assessments are no longer paid in full, I will lose early access to the pool.
I understand that I am swimming totally at my own risk and will be solely financially responsible for any injuries or disabilities suffered. The Association recommends that you not swim alone and have another community member present to call for help in the event of an emergency.
Prior to swimming, I will check the pool phone for a dial tone to verify its correct operation. I will notify PPM immediately and will not enter the pool if the pool phone is not functioning.
I agree to take full responsibility for my actions and the actions of any minors or guests I bring to the pool during unguarded hours. I understand my association may have specific rules related to minors and guests and shall follow those rules, as written.
I agree to follow all posted pool rules and regulations, including those related to safety, hygiene, and conduct.
I understand that I am prohibited from providing access to the pool to anyone other than myself during unguarded pool hours.
This waiver is valid only for the current year’s pool season and is null and void if the facilities close due to weather, mechanical, chemical, Health Department, or other reasons. I understand that if I violate any of these rules this privilege will be revoked for the remainder of the pool season.
